1. Scope of These Terms
These business and subscription terms govern the commercial relationship between Tribi Technologies and the organization (“Customer”) that subscribes to the SensePour platform. They are accepted on the organization's behalf by the person who creates it, who confirms they are authorized to bind it. They apply in addition to the personal Terms of Service each individual user accepts for their own account.
2. Subscription and Term
The subscription begins when the organization is activated and continues for the agreed billing period, renewing automatically unless either party gives notice before the end of the current period. The selected plan determines the number of venues, bars, and connected devices included.
3. Fees, Billing and Taxes
Fees are invoiced in advance for each billing period in the currency stated on the order. Amounts are exclusive of VAT and any other applicable taxes, which are added where required by law. Overdue invoices may lead to suspension of the service after written notice.
4. Hardware and Equipment
Cradles, sensors, and hub devices supplied with the service remain configured for use with the platform. The Customer installs them as instructed, keeps them powered and connected, and reports damage or loss. Consumables and replacements are charged separately unless covered by warranty.
5. Customer Data
Pour events, inventory records, and sales data uploaded or generated through the platform belong to the Customer. Tribi Technologies processes them to provide and secure the service and to produce aggregated statistics that do not identify the Customer. Processing details are set out in the privacy policy.
6. Availability and Support
Tribi Technologies aims to keep the platform continuously available and carries out planned maintenance outside peak hours where practical. Support is provided through the channels published on the support page during the stated business hours.
7. Customer Obligations
The Customer keeps its user accounts accurate, grants and revokes access for its own staff, and ensures the platform is used in line with these terms and applicable law. The Customer is responsible for the acts of the users it authorizes.
8. Limitation of Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential loss, including lost profits or lost data. Total liability for any claim is limited to the fees paid for the service in the twelve months before the claim arose.
9. Suspension and Termination
Either party may terminate at the end of a billing period by written notice. Tribi Technologies may suspend the service for non-payment or for use that breaches these terms, after notice where circumstances allow. On termination the Customer may export its data for a reasonable period before it is deleted.
10. Governing Law
These terms are governed by and construed in accordance with the laws of the European Union and the applicable national laws of the country where our registered office is located.
11. Changes to These Terms
Tribi Technologies may update these terms. Material changes are announced in advance by email or in-app notice, and a new major version requires the organization to accept it again before continuing to use the platform.
